What exactly does "while his administration considers new strategies for prosecuting terrorists" mean?

I see this as extending a hand just to slap a cuff on it, then trowing away the key. It's a diplomatic tactic to pull wool over the eyes of the terrorists...it's a last ditch, grabbing at straws "plan B" and I don't think it will do anything but make us no better than they are...
